Cecil Court Postal History Auction
Cecil Court Postal History Auction herein after called "CCPHA"
as "auctioneer", exercises all reasonable care to ensure that
all statements within descriptions as to condition, cancellation, centering,
colour, date of issue (postal marking), gum, paper, perforation, printing,
margins, provenance, quality, source, sheet position, status, usage, watermark
and other philatelic terms, in "lot" descriptions are accurate
and reliable. That each single item or "lot" is authentic or
genuine unless otherwise indicated. These statements within descriptions
are not intended to be and are not to be taken as statements of fact.
The statements are the opinion of the auctioneer, attention is particularly
drawn to clause 5 below.
Any expressions, comments, opinions, annotations concerning the characteristics
mentioned above which may be found as attached to single items or within
any lot (i.e. notes of catalogue prices) descriptions do not constitute
any part of the auctioneers statements within the description unless otherwise
specifically verified or indicated by the auctioneer.
Clause 1:
(a) Each lot is offered subject to any reserve.
(b) The highest bidder for each lot, subject to clause (a), shall be the
purchaser.
Clause 2:
(a) The bidding or advances shall be regulated at the absolute discretion
of the Auctioneer.
(b) The Auctioneer reserves the right to refuse any bid or bids.
Clause 3:
(a) During or before a sale CCPHA reserves the right to group together
or split items or lots belonging to the
same vendor.
(b) The Auctioneer reserves the right to withdraw any lot or lots at his
absolute discretion without giving reason
for doing so at any stage.
(c) CCPHA reserves the right to bid on behalf of buyers and vendors, but
shall not be liable for errors or omissions
in executing instructions.
(d) Not withstanding clause 3(c), vendors purchasing material are liable
to commission and other charges related
to their original consignment.
(e) CCPHA acts as agents only, and therefore shall not be liable for any
default of the purchaser or vendor.
Clause 4:
(a) Each lot shall remain the property of the vendor, until fully paid
up, but lots shall be at the purchasers
risk from the fall of the gavel.
(b) Delivery will not occur if lots are not fully paid within 7 days of
receipt by a UK purchaser, 14 days by overseas
purchasers of much longer agreed in writing between CCPHA and the
purchasers, prior to or at the point of
sale.
(c) Should any purchaser fail to pay in full within the time stated above
(4(b)) such lot or lots, shall, at the auctioneer's
discretion, be put for sale by auction again or sold privately. Such a
purchaser shall make good any difference
in price, reduction in premium or commissions and costs
of re-sale which shall become a debt due from any such a client. Any
increased price brought in by such a sale
will not be credited over and above the original defaulted sum.
(d) Interest at 2% per month shall be payable by the purchaser on any
amount due. CCPHA shall have discretion
to waive any such payment of interest.
Clause 5:
(a) Each lot is sold
(i) genuine unless otherwise described in the
sales catalogue or by the auctioneer and
(ii) correctly described. The date of any certificate
forming part of the description ant lot will
be included in the description.
(b) A purchaser shall be at liberty to reject any lot if
(i) the auctioneer reserves the right to receive
written notice with the attention of questioning
genuineness of any lot of an overseas purchaser - 14 days prior to the
date of sale and
(iii) returns to the auctioneer within 21
days (30 days overseas) from the date of sale the lot
in the same condition as it was at the time of the sale. Provided
that the auctioneer may,
at his discretion, on receiving a request in writing from the purchaser,
extend for a
reasonable period the time for return of the lot to enable it to
be submitted for expertisation.
Note:
The onus of proving a lot not to be genuine or incorrectly described,
is on the purchaser. The inability of a recognized expert or expert committee
to express a definite opinion shall serve to discharge the onus on the
purchaser and shall be a ground for rejecting the lot concerned.
(c) Where a lot has been submitted for expertisation all costs shall
be paid by the person who retains the certificate
and item or items to which the certificate relates.
(d) Where the purchaser of a lot discharges the onus and acts in accordance
with clause 5(b) of this clause, the auctioneer
shall rescind the sale and repay in respect of the lot.
(e) No lot shall be rejected if, subsequent to the sale, it has been immersed
in water marked by an expert or expert committee
or treated by any other process unless the auctioneers permission
to subject the lot to any such immersion, marking or treatment has first
be obtained in writing.
(f) Any lot described as a "collection" or as "various"
or stated to comprise or contain a collection,
issues or stamps which are undescribed shall be put up for sale not subject
to rejection and shall be taken by thee purchaser
with all (if any) faults lack of genuineness and errors
of description and numbers of stamps in the lot and the purchaser shall
have no right to reject the lot, expect that,
notwithstanding the foregoing provisions of this sub-clause where before
a sale a person intending to bid at the sale gives notice in writing to,
and satisfies, the auctioneer that any such lot
contains any item or items shall, as between the auctioneer and that
person be taken to form part of the description of the lot the purposes
of sub clauses (a), (b) and (d) of this clause.
(g) No lot illustrated in the catalogue shall be rejected on the grounds
of centering, cancellation, margins, perforation
or other characteristic clearly apparent from the illustration.
(h) A set, consisting of more than on stamp, cannot be returned because
of damage to an individual stamp(s) in good
condition exceeds the "catalogue" price of the set.
Special Conditions:
1. A service charge of the 2% will be charged if currency other than GB
sterling is used to settle an account, to cover
bank charges.
2. Lots viewed or photocopies are unreturnable.
3. Where there are two or more lots described as similar lots and are
identical in content, value or weight a bid for
such a lot will be equally valid for any "similar" lot, unless
instructions are given to the contrary.
